Terms & Conditions

These Terms and Conditions govern the use of services, facilities, classes, memberships, programs, products, and all related offerings provided by Sculpt Studios OC LLC / Sculpt Studios Pilates (“Sculpt Studios”).

These terms apply to all members, participants, guests, clients, and visitors who enter the studio, book classes, purchase services or products, or otherwise interact with Sculpt Studios.

By booking classes, purchasing services or products, entering the studio, or interacting with Sculpt Studios systems, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions.

Use of Studio Facilities

Access to Sculpt Studios facilities is provided only to individuals who agree to comply with studio rules, policies, and safety guidelines.

Sculpt Studios reserves the right to deny entry, suspend participation, or terminate memberships or services at its sole discretion for behavior deemed unsafe, disruptive, abusive, or in violation of studio policies.

Class Reservations

Class reservations may be made through the studio’s official booking platform.

Participants are responsible for ensuring their reservation is completed correctly.

Class spaces are limited and available on a first-come, first-served basis.

Late Arrival Policy

Participants should arrive at least 10 minutes before class.

A 3-minute grace period is permitted after class begins. Entry may not be allowed after that time to maintain class safety and minimize disruption.

Late arrivals may be treated as a late cancel or no-show.

Class Cancellation Policy

Participants must cancel their reservation at least 8 hours before the scheduled class start time.

Late cancellations will result in a $15 late cancellation fee.

No-Show Policy

Participants who reserve a class but fail to attend without canceling will incur a $20 no-show fee.

Class pack users may also lose the class credit associated with the reservation.

Membership Terms

Certain memberships may require a minimum commitment period.

Membership cancellation requests must be submitted in writing via email according to Sculpt Studios policies.

Requests must be received at least 14 days before the next billing date.

Membership fees are non-refundable.

Membership Freeze

Membership freezes may be permitted in accordance with studio policies.

Freeze requests must be submitted in advance and cannot be applied retroactively.

Purchases & Payments

All purchases made through Sculpt Studios, including:

• memberships

• class packs

• drop-in classes

• beverages

• retail items

• supplements

• merchandise

are final and non-transferable unless otherwise required by law.

Sculpt Studios reserves the right to modify pricing, services, or offerings at any time.

Refund Policy

All sales are final.

Refunds will not be issued for:

• unused memberships

• unused class packs

• missed classes

• late cancellations

• no-shows

• early membership cancellations

Refunds may only be issued in cases of documented medical necessity or where required by law.

Chargebacks & Credit Card Disputes

Participants agree that they will not initiate a chargeback or payment dispute without first contacting Sculpt Studios to attempt resolution.

If a chargeback or dispute is initiated, Sculpt Studios reserves the right to:

• suspend memberships or services

• deny future bookings or purchases

• charge an administrative fee related to the dispute

• pursue recovery of outstanding balances

Participants acknowledge that chargebacks filed in violation of studio policies may be formally contested, and Sculpt Studios may submit documentation including waivers, booking confirmations, purchase records, and policy acknowledgments.

Payment disputes must be resolved according to the arbitration provisions contained in these Terms and Conditions.

Beverages, Products & Supplements

Sculpt Studios may offer water, electrolyte beverages, vitamins, supplements, or other products.

Participants who consume these items do so voluntarily and at their own risk.

Sculpt Studios is not responsible for allergic reactions, sensitivities, illness, or other health issues related to the consumption of beverages, supplements, or products purchased or provided at the studio.

Photography, Video & Media

Photography or video recording may occur during classes, events, or studio activities.

Images may be used on:

• social media

• studio websites

• promotional materials

• marketing campaigns

Participants who do not wish to appear in photos or videos must notify the studio in writing prior to attending class.

Personal Property

Participants are responsible for securing their personal belongings.

Sculpt Studios is not responsible for lost, stolen, or damaged personal property.

Parking

Participants must follow posted parking guidelines.

Sculpt Studios is not responsible for parking violations, towing, damage, or incidents occurring in parking areas.

Limitation of Liability

To the fullest extent permitted by law, Sculpt Studios shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in studio activities or use of services or products.

Arbitration & Dispute Resolution

Any dispute arising from participation in Sculpt Studios activities shall be resolved through binding arbitration on an individual basis, except where prohibited by law.

Class Action Waiver

Participants agree that any claim must be brought solely in an individual capacity and not as part of any class action, consolidated action, or representative proceeding.

Participants waive the right to participate in class actions or class arbitration against Sculpt Studios or any affiliated parties.

Governing Law & Venue

These Terms and Conditions shall be governed by the laws of the State of California.

Any claims not subject to arbitration shall be brought exclusively in the Superior Court of California, County of Orange.

Owner & Affiliated Entity Protection

Participants acknowledge that Sculpt Studios operates as a limited liability entity.

To the fullest extent permitted by law, the studio owner and any entities owned, operated, managed, or controlled by the studio owner, whether currently existing or created in the future, shall not be held personally liable for claims arising from participation in studio activities or use of Sculpt Studios services.

Online Conduct & Defamation

Participants agree not to post or distribute false, defamatory, abusive, or misleading statements about Sculpt Studios, its owners, instructors, staff, affiliates, or services.

Knowingly false statements or harassment intended to damage the reputation of Sculpt Studios may result in termination of services and potential legal action where permitted by law.

Intellectual Property

All Sculpt Studios branding, logos, class formats, training methods, written materials, videos, images, and digital content are the exclusive property of Sculpt Studios.

Participants may not reproduce, distribute, copy, or commercially use studio materials without written permission.

Unauthorized Recording

Recording, filming, broadcasting, or distributing Sculpt Studios classes or instruction for commercial purposes is prohibited without written authorization.

Right to Refuse Service

Sculpt Studios reserves the right to refuse service, suspend accounts, or revoke access to individuals who violate studio policies or engage in unsafe or disruptive conduct.

Electronic Agreement

Acceptance of these Terms through digital signature, online booking, electronic acceptance, or platform acknowledgment constitutes a legally binding agreement.

Electronic records maintained by Sculpt Studios serve as valid proof of acceptance.

Right to Modify Terms

Sculpt Studios reserves the right to update or modify these Terms and Conditions at any time.

Continued use of studio services constitutes acceptance of the updated terms.

Acknowledgment

By booking a class, purchasing services or products, entering the studio, or interacting with Sculpt Studios systems, participants acknowledge that they have read, understood, and agreed to these Terms and Conditions.
